If you have questions on any of the information, please answer the question to the best of your ability but also indicate that on the form, and we will follow up with you to ensure your information is accurate. Once we have had a chance to review the form, we will advise as to the correct type of file and/or hard copy of material that needs to be submitted as a deposit with the US Copyright Office in order to complete your application submission.

Please be advised that copyright application take, on average, about six months to process, and oftentimes during that period, we have no communications from the US Copyright Office regarding the status of your application. Should any information become available, we will certainly keep you updated promptly.

Publication, for the purposes of copyright law is defined as: “Publication is the distribution of copies or phonorecords of a work to the public by sale or other transfer of ownership, or by rental, lease, or lending. The offering to distribute copies or phonorecords to a group of persons for purposes of further distribution, public performance, or public display constitutes publication. A public performance or display of a work does not of itself constitute publication.” Generally, publication occurs on the date on which copies of the work are first made available to the public.

Group Photography Registration Addendum
For group photography, there is a special application process. You must submit an application for unpublished photography separately from published photography. In addition to the application all photos must be uploaded and logged on an excel spreadsheet to be submitted for copyright.
You will be required to submit what is called the “best edition” of work to the Copyright Office. The ‘best edition’ of a work is “the edition, published in the United States at any time before the date of deposit, that the Library of Congress determines to be most suitable for its purposes.” Such best edition will be determined based upon the type of work that you are submitting, and attorney will advise in what format such work must be submitted.
In order to do a group photography registration, you must confirm:
- Was the collection of photos taken by a single person or organization?
- Do the photographs have the same claimant (person or entity who can assert copyright rights)?
- Are your photos in the accepted form for upload? Below is a list of suitable forms.
- Are there 750 or less photographs?
- Are all of the photographs either published or unpublished?
Once we determine the correct type of applications, we will send you the appropriate spreadsheet and instructions for how to get your work to us for submission.
